Council of Ministers of BIH Holds Its 44th Session

The Council of Ministers of BIH adopted, upon a proposal by the Chairwoman of the Council of Ministers of BIH, an Annual Intelligence-Security Platform, which contains guidelines for the Intelligence-Security Agency of Bosnia and Herzegovina for an effective activity in its scope of action, with focus on protection of security in BIH, its values, and interests.
The document emphasises commitment of our country for fight against organised crime and all its firms, through which Bosnia and Herzegovina strengthens its relevant cooperation with the European Union and contributes to regional stability, in accordance with the BIH-EU Stabilisation and Accession Agreement.
RATIFICATION OF CEEPUS IV AGREEMENT
The Council of Ministers defined, upon a proposal by the Ministry of Foreign Affairs, a Proposal Decision on ratification of the Central European Exchange Programme for University Studies (CEEPUS IV), signed on September 20, 2023, in Warshaw.
The Programme contributed to development of European high education and regional academic mobility among 15 SEE countries.
CEEPUS IV should take force in 2025, to replace the CEEPUS III Programme, in which BIH takes an active part at present.
GUIDE TO ACCESS TO INFORAMTION
The Council of Ministers of BIH took the Ministry of Justice-proposed Guide for access to information, which ensures effective implementation of the Law on Freedom of Access to Information at BIH Institutions level.
The adoption of the Guide enables all citizens to realise in an easy, faster, and simple way their right to access to information, kept with the BIH Institutions.
All BIH institutions are obliged to publish the Guide for access to information at their web sites, together with relevant forms, namely, request for access to information, request to repeated use of documents, and request for supplement or correction of information, thus harmonising previous differing practice and ensures equal access to information.
This is to ensure transparency of procedures and equality of all interested parties in realisation of their right to smooth access to information before all institutions of BIH.
HARMONISATION OF BIH LEGISLATION WITH EU ACQUIS
The Council of Ministers of BIH adopted the Directorate for European Integrations-tabled piece of information on application of a Decision on process of harmonisation of Bosnia and Herzegovina legislation with acquis of the European Union in time between January 1-December 31, 2023.
State Ministries and other BIH Institutions and managers of administrative bodies, authorised to take regulations, should provide to the Council of Ministers Directorate for European Integrations all regulations, the implementation ones and others fulfilling obligations stemming from documents relevant for BIH integration to the EU, for the purpose of check and verification of harmonisation thereof with the EU acquis.
The Directorate for European Integrations gave its opinion last year on harmonisation of 54 regulations published in the “Official Gazette of BIH”, among 41 regulations were in the process of harmonisation with the EU acquis.
Four regulations relevant for the European integrations process were taken and published without previously obtained Direction’s opinion on harmonisation, reads the piece of information, reiterating an obligation for administrative bodies to a consistent implementation of the Decision on procedure of harmonisation of BIH legislation with EU acquis.
PIECE OF INFORMATION ON MIGRATIONS
The Council of Ministers of BIH took the Ministry of security-tabled piece of information on situation in migrations in Bosnia and Herzegovina for 2023, which will be provided to the BIH Presidency, House of Representatives and Parliamentarian Assembly Joint Committee for Defence and Security.
According to the piece of information, foreigners in BIH were allowed 5,984 temporary stays last year, most of which based on labour with work permit (1,897 or 32%), family reunion (1,389 or 23%), and education (1,356 or 23%), and prolonged were 7,497 temporary stays, most of which for family reunion. Approved were 474 permanent stays in the reported time.
The BIH Border Police detected 13,643 individuals in illegal border crossing or attempted ones. From territory of the Republic of Serbia discovered 6,110 individuals, among which 5,193 were diverted in accordance with the Law on Border Control. At exit from BIH 7,553 individuals were discovered last year.
Migrants usually use areas beyond border-crossings for illegal crossing of the state border, while 50% of cases of attempted crossings if border by way of hiding 440 migrants in cargo area of cargo motor vehicles.
Total 34,409 illegal migrants were reported in 2023, for 25,45% more than a year before, and most of them were from Afghanistan (14,442).
For the last six years, more than 142,000 migrants passed across the BIH territory, and 122 different citizens were detected in illegal migrations last year.
IMPLEMENTATION OF INTEGRATED BORDER MANAGEMENT STRATEGY
The Council of Ministers of BIH adopted a Report on implementation of 2023 Bosnia and Herzegovina Integrated Border Management Strategy Action Plan, developed by the Coordination Body comprised of representatives of 10 institutions and police agencies from around BIH.
The Report gives a review of progress made in harmonisation of BIH legislation with the European legal framework, development, and establishment of new information systems in the area of border checks, as well as measures taken for better border surveillance, suppression of cross-border crime, international protection and treatment of vulnerable categories.
It was about strengthening cross-agency cooperation in BIH, while as to international cooperation, activities were implemented for intensification of cooperation with neighbouring countries and FRONTEX, as well as establishment of a coordination centre for data exchange (NCC-EUROSUR).
GRANT OF VEHICLES FOR CLINIC IN MUNICIPALITAY OF ČAJNIČE
The Council of Ministers of BIH took a decision on transfer of ownership rights over fix assets, thus creating conditions for the Ministry of Security of BIH to transfer free of charge a right to ownership to a motor vehicle without reimbursement to Public Health Unit “Vaso Pelagić” Clinic in the Municipality of Čajniče.
It is a “Volkswagen” caddy type of vehicle to be granted to the “Vaso Pelagić” Clinic, as a support to health worders in providing medical services to citizens and migrants in the Municipality of Čajniče, which is situated on the route of intensified migrant movements from Serbia and Montenegro through Bosnia and Herzegovina.
PROGRESS IN IMPLEMENTATION OF RULES FOR CONSULTATIONS
The Council of Ministers of BIH adopted the Ministry of Justice-tabled report on implementation of Rules for Consultations concerning development of legal regulations for 2023, which points at a progress made and gives recommendations for continued improvement of the process.
The web platform eKonsultacije registered 68 institutions in time of the report drafting, which is more for one institution relative to 2022.
Last year witnessed 569 consultations in development of legal regulations and other acts, and published were 484 reports on consultations implemented, while all BIH institutions (registered at web platform eKonsultacije) appointed their coordinators and deputy coordinators for consultations.
Total 275 participants were checked in for participation in public consultations, of which 108 participated. Total 43 proposals arrived, 45 of which were accepted fully or partially by institutions.
The web platform eKonsultacije registered total 3,460 legal and natural persons last year and the number keeps increasing.
REALISATION OF BIH AIR SPACE MANAGEMENT
The Council of Ministers of BIH adopted the Ministry of Communications and Transport-tabled report on realisation of 2023 BIH Air Space Management Policy.
Statistics on overpasses across BIH air space indicate a growth relative to levels from 2019 and 2022, while takings off and landings from international airports were 1% less than in 2022, due to a decrease of operations by Wizz Air and closing of its bases at international airports Sarajevo and Tuzla.
The average number of aircraft overpasses in BIH air space last year was 1,420, most of them was registered on July 29, 203, when 2,162 aircraft overpasses were registered, and most of air operations within an hour, 154 of them, was registered in time between 9.40 and 10.40 hrs.
In terms of aircraft operations in the area of responsibility of Units of Access and Airport Flight Control (JPKAL) in Sarajevo, Mostar, Banja Luka, and Tuzla, 30,062 operations were evidenced last year, and a year before there were 31,481.
The most of operations were registered by JPKAL Sarajevo 17,199, and the least by JPAK Mostar 841, while JPKAL Tuzla and Banjaluka registered 5,498 and 6,524 operations, respectively.
REGIONAL HOUSING PROGRAMME
The Council of Ministers of BIH adopted a Final Report on implementation of the CEB-BIH Framework Agreement for Regional Housing Programme (RSP), to be provided to the BIH Presidency and Parliamentarian Assembly of BIH.
The Regional Housing Programme was successfully closed in 2023, and its implementation with financial support by the European Union and donor-countries resulted in permanent housing in more than 11,300 beneficiary families or close to 36,000 individuals in four partner counties, namely, Bosnia and Herzegovina, Montenegro, the Republic of Croatia, and Republic of Serbia.
Thanks to the regional Husing Programme, 2,778 housing units were constructed or reconstructed (890 flats and 1,888 houses) for housing of about 9,000 most vulnerable refugees, displaced persons, and returnees, thus successfully ending their long-years displacement.
The Ministry for Human Rights and Refugees should continue its work on securing missing finances for reconstruction and construction of housing units for remaining selected beneficiaries of the Regional Housing Programme, works on homes thereof remain to be completed. This would be done in cooperation with responsible ministries and other bodies included in the Dayton Peace Agreement Annex 7 implementation.
LAW ON ARMS AND MILITARY EQUIPMENT MOVEMENT CONTROL IN IMPLEMENTATION
The Council of Ministers of BIH adopted the Ministry of Security-tabled report on 2023 implementation of a Law on Arms and Military Equipment Movement Control.
According to the report, 900 decisions were issued approving movement of arms and military equipment, which is 7.91% more than in 2022.
Out of the number, 514 decisions referred to export and 386 to import of arms and military equipment. Total 46 economic entities filled requests for movement of arms and military equipment, and total 453 approvals were issued last year for movement between Entities, Cantons, and the Brčko District of BIH, which 11.85% more than a year before.
CONSENT TO APPOINTMENT
The Council of Ministers of BIH granted its consent, as proposed by the Ministry of Foreign Affairs, to appointment of Colonel Toni Stojanovski for a Defence Attaché of the Republic of North Macedonia, with his seat in Ljubljana.
POOLING BY CITIZENS FO HUNGARY STAYING IN BIH
The session granted tis consent to vote by citizens of Hungary, staying in territory of Bosnia and Herzegovina, regarding elections for the European Parliament.
The pooling will be organised in the Embassy of Hungary in BIH in Sarajevo, on June 9, 2024, in time between 6.00 to 19, 00 hrs.(end)
