Council of Ministers of Bosnia and Herzegovina Holds Its 58th Session

The Council of Ministers of BIH took the Ministry of civil Affairs-proposed five decisions on defining criteria for awarding grant funds for 2024-2026 to support projects in areas of sports, international cultural cooperation, innovations, project preparation for funds form Horizon Europa Fund, and NGO projects co-financing for HIV an TBC prevention in BIH.
The funds are to be provided under the Law on Budget of BIH Institutions and International Obligations of BIH from 2024 “Current Transfers and Grants” item, while funds for 2025 and 2026 will be secured form the Budget from each year severally.
Individual decisions define criteria for allocation of grant funds for co-financing of sports events (KM 1,342,000), for international cultural cooperation (KM 390,000), of which Km 100,000 were approved for project co-financing approved within the EU Creative Europe Programme (444,000), including for co-financing of NGO projects for prevention of HIV, TBC and addiction (KM 50,000).
The funds will be allocated as per criteria prescribed according to these decisions by way of public competition published at he Ministry of Civil Affairs web site and in three daily papers circulating throughout BIH.
CoM BIH FINANCIAL SUPPORT TO FAIRS IN COUNTRY AND ABROAD
The Council of Ministers of BIH took a decision on criteria for distribution of current grants of the Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina for 2024-2026 for the purpose of promotion and development of BIH economy.
The decision defines criteria and way of distribution of grants for support to fair events, worth total KM 900k for 2024, of which KM 600k is intended for support to fair and other events and activities in country, and KM 300k are untended for support to fair and other activities abroad.
Funds from the Ministry of Foreign Trade and Economic Relations current grant for 2025 and 2026 will be defined by Laws on Budget of BIH and International Obligations of BIH for each year severally.
The funds are allocated to organisers of fair and other events and activities in country and abroad for the purpose of promotion of entrepreneurial activities, especially youth and women, increase of competitiveness, networking with consumers and business partners, advertising of our products at market and better positioning at the existing and creation of conditions for sales at new markets.
The Ministry of Foreign Trade and Economic Relations will publish a call to organisers of fair and other events and activities in country at its web site and in three daily papers circulating throughout Bosnia and Herzegovina.
ALIGNING WITH STANDARDS OF WORLD ORGANISATION FOR ANIMAL HEALTH
The Council of Ministers of BIH took the Ministry of Foreign Trade and Economic Relations-proposed Decision on amendment of Decision on ban of import and transport of certain consignments to Bosnia and Herzegovina for the reason of prevention of avian flu, drafted by the BIH Veterinary Office.
The session took two more decision on amendment of decisions on ban of import and transport of certain consignments to Bosnia and Herzegovina for the reason of prevention of classic swine plague and African swine plague.
These Amendments up-date list of countries and territories fee form highly pathogen avian influence, swine plague and African swine plague, in accordance with standards of the World Organisation for Animal Health (WOAH), now including Russia, from where export of earlier forbidden shipments is now enabled.
Simultaneously, the Council of Ministers of BIH took the Ministry of Foreign Trade and Economic Relations-proposed Decision on Supplements to Decision on ban of import and transport of certain consignments for the reason of prevention of bringing the food and mouth disease to Bosnia and Herzegovina, pursuant to standards of the World Organisation for Animal Health.
BIH FOLLOWS EU PRACTICEE AND IMPLEMENTS ZOSPI: DOCUMENTS REUSE
The Council of Ministers of BiH took the Ministry of Justice-proposed Rulebook on Kinds and Contents of Conditions for Re-Use of Documents and Rulebook on Contents and Evidence Keeping of Exclusive Rights to Documents Re-Use, with corrections made at the session.
Thus, the Law on Freedom of Access to Information (ZOSPI)-stemmed obligations are fulfilled, and the relevant procedures are aligned with the EU acquis to extend allowed by the current EU integrations process of Bosnia and Herzegovina.
The Rulebook on Kinds and Contents of Conditions for Documents Re-Use will enable smooth use of rights to documents reuse for all users under equal conditions for same or similar documents, for either commercial or non-commercial purposes. Also, user will be enabled simpler and faster execution of rights to documents re-use. To the end of increased transparency, BIH Institutions are obliged to make documents publicly accessible at their web sites in an open and machine-readable form with mega data.
The Rulebook on Contents and Record Keeping of Exclusive Right to Documents Re-Use will secure publicly accessible evidence on all approved exclusive rights, kept by Bosnia and Herzegovina Ministry of Justice Administrative Secretariat.
The Rulebook elaborates that in line with ban of discrimination, documents re-use is approved and accessible to all applicants with equal fee and under equal conditions.
The Council of Ministers of BIH took the Ministry of Finance and Treasury-proposed decision on level of fee for material costs, in accordance with the Law on Free Access to Information (ZOSPI) at Bosnia and Herzegovina Institutions level.
According to the Decision, both legal and natural persons will get free of charge up to 20 pages of requested information at the BIH Institutions level, including copying of pages and turning them from hard to electron copies, and each next standard size page will be paid KM0.50 for copying and KM 0.30 for turning it into electronic form. For each CD charge is KM1, for DVD it is KM 2, and for USB stick charge is KM 10.a
It is about paying o real material costs for providing information, as well as costs of information provision under accounting of the existing postal service price.
Taking effect of this decision invalidates earlier decision form 2011 on cost of copying of requested information, in accordance with the Law on Free Access to Information in Bosnia and Herzegovina, and 2019 amendment thereof, under which fee for pages copying was KM0.50 and for diskette for electronic document was KM 10.
KM 3 MIL. FOR ARBITARAGE PROCEDURE: TO TAKE LEGAL ACTIONS AGAINST DISPUTE-RELATED LOWER AUTHORITY LEVELS
The Council of Ministers took the Chief Attorney’s Office-proposed decision on finance sources and way of execution of financial obligations for the purpose of holding international investment arbitrage procedure in legal matter of claimants Pramod Mittal, Sangeeta Mittal, Vartika Mittal, Shirsti Mital and Divyesh Mittal against claimed Bosnia and Herzegovina.
Funds in amount of KM 3 mil. from BIH Institutions Budget were approved for holding this international investment arbitrage procedure, initiated by the claimant against BIH, referring to earlier concluded agreement between Bosnia and Herzegovina and the Republic of India on investment promotion and protection, and in relation with his investment to Global Ispat Kox Industry, Ltd. Lukavac (GIKIL, Ltd, Lukavac).
The approved funds will be paid per payment instructions of the BIH Chief Attorney’s Office successively to the Ministry of Finance and Treasury for making-up for costs of the procedure before ad hoc international arbitrage.
The BIH Chief Attorney’s Office should, upon the end of the arbitrage procedure and for sake of protection of financial interests of Bosnia and Herzegovina institutions, according to the existing regulations, take certain legal actions towards lower levels of authority to which this arbitrage procedure refers.
HIGHER COURT IN BERN REJECTS REQUEST FOR ENFORCEMENT OF DAMAGE: BIH IS NOT OBLIGOR IN FILE “MURTIĆ AND ĆEMIROVIĆ”
The session adopted a piece of information on an activity by the Chief Attorney’s Office of Bosnia and Herzegovina in realisation of the BIH Council of Ministers conclusion, adopted at its 38th session of Feb. 9, 2024, in connection to initiated enforcement of damage, under 2012 European Court for Human Rights award in file Murtić & Ćemirović vs Bosnia and Herzegovina, ap.No.6495/09.
The Chief Attorney’s office informed the Council of Ministers of BIH that the Higher Court of Bern Canton eventually refused a request for enforcement of damage by the creditor in amount of CHF 11,137,545.85, moving Bosnia and Herzegovina off the list of obligors in the Enforcement Damage Office, due to which no further legal actions are needed in the procedure. All process and count costs from the procedure were invoiced to the creditor UNA TRUST&INVESTMENT GMBH.
Bosnia and Herzegovina made-up all its obligations under 2012 European Court for Human Rights award in file Murtić & Ćemirović, as confirmed by the Council of Europe Committee of Ministers in its resolution of March 9, 2024. The award referred to only two applicants who have started the procedure before the European Court for Human Rights and yielded award in file Murtić & Ćerimović vs BIH of June 19, 2024, save from all other Agrokomerc shareholders, as misinterpreted by UNA TRUST&INVESMTENT GMB, representing 2,767 Agrokomerc shareholders.
FOREIGN EXCHANEG IN Q I 2024
The Council of Ministers of BIH adopted an Analysis of Foreign Trade Exchange of Bosnia and Herzegovina for 2024 I-III, drafted by the Ministry of Foreign Trade and Economic Relations of BIH.
The total goods exchange of Bosnia and Herzegovina in 2024 QI was KM 10,66 billion, of which, the value of exported gods was KM 3.85 billion and of the imported goods KM 6.8 billion, so foreign trade deficit was KM 2.96 billion.
The total foreign trade exchange marks a fall for 2.60% relevant to the same time last year, with an export increase for 4.05% and decrease of export for 12.50%. The European Union is still our main foreign trade partner with total export of KM 2.89 billion, which is a drop of 10.87%, compared with the same time last year, while the import from the EU was KM 4.06 billion, which is more for 4.39 % relevant to import in Q I last year. As to main trade partners, the major coverage of import by export was with Austria 157.82 %, Croatia 141.24 %, Slovenia 126.42 % Germany 74.01 %, and Serbia 61.17%.
HARMONISATION OF REGULATION ON USE OF SPECIAL PURPOSES VEHICLES
The Council of Ministers of BIH granted its consent to a Regulation on conditions of procurement and use of official vehicles for special purposes in the Ministry of Foreign Trade and Economic Relations of BIH, for the reason of harmonisation thereof with 2023 Regulation on Procurement and Use of Official Vehicles in BIH Institutions.
The Ministry of Foreign Trade and Economic Relations disposes of two vehicles for special purposes, namely, one granted lower class passenger vehicle worth to KM30,000 and another lower middle-class vehicle of KM 60,000 procurement price.
With defining ways of procurement and use of these vehicles, the Regulation prescribes responsibility of individuals running official vehicles for special purposes.
The session granted its consent to a Regulation on Official Vehicles for Specialised Purpose in the Identification Documents, Evidence and Data Exchange Agency of Bosnia and Herzegovina.
The Regulation covers 23 official vehicles for specialised purposes disposed by the Agency in its main office and regional centres. These Regulations make harmonisation with earlier adopted Regulation on Conditions for Procurement and Use of Official Vehicles in BIH Institutions, and it also defines procedures of ways of use of vehicles, among which, rights and responsibilities of individuals using them, with defining criminal ana material responsibility of employees using them.
REALISED 80% CoM BIH CONCLUSIONS IN Q I 2024
The session considered a Review of Realisation of Conclusions of the BIH Council of Ministers for 2024 Q I.
The Review, drafted by the Council of Ministers Secretariat-General covered 22 institutions of the Council of Ministers of BIH. These institutions realised 146 or 80 % conclusions, out of 182 adopted, while 36 conclusions remained non-realised, in Q I.
The session concluded that the conclusions realisation should be accelerated, in order to secure higher effecacy of the Council of Ministers operations.
SOCCER PLAYER ĐAKOVAC GETS BIH CITIZENSHIP
The Council of Ministers of BIH took a decision on granting citizenship of Bosnia and Herzegovina to citizen of the Republic of Serbia Ifet Đaovac, soccer player and potential member of the soccer national selection of Bosnia and Herzegovina, upon recommendation of BIH Football Federation.
FUNCIONAL AMENDMENTS IN CHIDREN’S COUNCIL
The Council of Ministers of BIH took the Ministry for Human Rights and Refugees-proposed Decision on Amendment of Decision on appointment of members of the Children’s Council of Bosnia and Herzegovina.
It is about a functional replacement of four members, who are not anymore at posts responsible for promotion and protection of child rights, namely two members from the Ministry for Human Rights and Refugees and one from each the State Ministry of Justice and Foreign Affairs.
Kemo Sarač of the Ministry for Hamn Rights and regfugees was appointwed was appointe presidner o fhe Children+s’s Copuncil, instead of Saliha Đurdija, earlier transferred to a new post.
APPOINTMENTS AND TERMINATION OF APPOINTMENTS
The Council of Ministers considered a piece of information by the Ministry of Foreign Trade and Economic Relations on job vacancy procedure for three members of the State Aid Council of Bosnia and Herzegovina. Appointed members of the State Aid Council are Mira Vujeva, Aleksandar Ćirić and Rašid Kičić, as the best ranked candidates at the completed public job vacancy ad procedure.
The Council of Ministers of BIH appointed, upon a proposal by the Ministry of Foreign Trade and Economic Relations, Adela Vileš Bektaš for Deputy Director of the Plant Health Administration for a five-year term.
The Council of Ministers of BIH took a decision on termination of appointment to Deputy Director of the Institute for Standardisation of Bosnia and Herzegovina Borislav Kraljević, upon his own request, based on fulfilment of conditions for retirement.
Dragan Brković was appointed Acting Director until the end of job vacancy procedure, three months at longest. The BIH Civil Service Agency should implement the job vacancy ad procedure urgently for filling of the post.
The Council of Ministers terminated the term of appointment to Nedim Ćustović, Deputy Director of the Ministry of Finance and Treasury Central Harmonisation Unit due to his retirement.
Abdulah Đulović was appointed Acting Deputy Director of the Central Harmonisation Unit until the end of job vacancy ad procedure, to three months at longest.
CONSENT TO APPOINTMENT
Upon a proposal by the Ministry of foreign Affairs of BIH, the Council of Ministers granted tis consent for appointment of Colonel Dian Tsetskov Dakov to a post of Military and Air Envoy of the Republic of Bulgaria in Bosnia and Herzegovina. (end)
