Council of Ministers of Bosnia and Herzegovina Holds Its 29th Session

The Council of Ministers of BIH defined a Proposal Law on protection of right to trial within reasonable time span before the Court of Bosnia and Herzegovina, which should step-up those procedures risking excessive length.
The Proposal Law regulates the right to trial within a reasonable time span in court proceedings before the Court of BIH, protection of that right, as well as just compensation in case of violation thereof.
According to the Law, the right and length of reasonable time span will be set in accordance with the European Court for Human Rights practice.
Legal means for protection of right to trial within a reasonable time span are a request for protection of the right claim for just indemnification in case of breaching the right.
This introduces, in accordance with the Convention on Protection of Human Rights and Basic Freedoms, an effective legal mean to protect the right to trial within reasonable time span, although there have been no related appellations to date by parties concerned before the Court of BIH.
The Ministry of Justice will provide the Proposal Law to the Parliamentarian Assembly of BIH for further procedure under regular proceeding.
FULFILLED ADDITIONALLLY SET CONDITIONS FOR VACCINES DELIVERY VIA COVAX
Today’s session defined a Proposal Amendment of the Commitment Agreement - Committed Purchase Agreement between the Council of Ministers of Bosnia and Herzegovina and the Global Alliance for Vaccines (GAVI), to be sent to the BIH Presidency, and Minister of Civil Affairs of BIH Ankica Gudeljević was authorised to sign it.
Earlier, the Council of Ministers of BIH adopted a piece of information on a need to conclude the Amendment, after receiving positive opinion form responsible State, Entity and Brčko District of BIH institutions.
In mid-February, BIH got a new condition in terms of signing an amendment of the Contract, in the time it waited for arrival of the first earlier agreed and paid vaccine doses from COVAX. The Council of Ministers of BIH reserved KM 2.000.000 within an approved multi-annual project to make-up for costs to be incurred in the vaccines procurement process, including, among other things, delivery, import, distribution, transport costs, housing and quality insurance.
DIRECT VACCINES PROCURMENT FOR IMMUNISATION TAX FREE
The Council of Ministers of BIH took a decision to supplement a decision on waiving from indirect tax paid for equipment and means granted by domestic and international persons for the needs of prevention, containing and removing of epidemics, caused by corona virus.
The decision supplement enables all responsible public institutions in Republika Srpska, Federation of BIH and Brčko District of BIH to be freed from paying indirect taxes for direct procurement of medical countermeasures against Covid-19, thus a mass immunisation will be implemented free of charge, and BIH competent authorities will issue a confirmation that the medicines were procured for non-commercial purposes (free and voluntary immunisation).
It will make easier to responsible ministries and other health care institutions to procure independently medicines to treat Covid-19, in order to implement a free-of-charge mass immunisation in BIH.
The Ministry of Civil Affairs signed a Contract on vaccine procurement through Covax mechanism, in addition to an earlier singed agreement on mutual rights and obligations, however, no vaccine has arrived through Covax mechanism yet.
COOREPATION BETWEEN BIH AND REGIONAL WHO EUROPE OFFICE
The Council of Ministers of BIH defined a Proposal for conclusion of a Bi-Annual Cooperation Agreement between Bosnia and Herzegovina and the World Health Organisation Regional Office (WHO) for Europe 2020-2021.
The aim of the Agreement is to support Bosnia and Herzegovina in its efforts to maximise a possibility for citizens’ health promotion and decrease inequality in health by way of a cross-sector approach to health in all policies, i.e. general outreach, including governments. The agreement stresses a need for the improved overall health management by proposing new directions and approaches for a more just, sustainable and accountable health care development.
The Bi-Annual Agreement supports concepts, principles and values of the European Framework for Health and Well-being “Health 2020”, adopted at the 62nd session of the regional WHO Committee for Europe.
The Proposal Agreement is to be provided to the BIH Presidency, and the Minister of Civil Affairs was proposed for the BIH signatory.
ACTIIVITES LAUNCHED FOR SAFE AND HUMANE RETURN OF BIH CITIZENS FROM SYRIA AND IRAQ
The Council of Ministers of BIH adopted a piece of information of the Ministry of Security on citizens of Bosnia and Herzegovina staying at the conflict zone between Syria and Iraq, drafted for the aim of their repatriation.
The piece of information contains 14 conclusions, the implementation of which will secure a coordinated action of all responsible structures to secure safe and humane return and resocialisation of BIH citizens, men, women and children, who are still staying at the Syria-Iraq conflict zone.
The Ministry of Security was tasked to establish the system and procedures of the safe, humane and controlled return and acceptance of those individuals by way of setting-up a functional coordination team.
The Council of Ministers of BIH will appoint the coordination team, to be proposed by the Ministry of Security, in cooperation with other competent all-level institutions/agencies in BIH. The team will include representatives of the BIH Prosecutor’s Office, state Ministries of Foreign Affairs, Civil Affairs, Human Rights and Refugees, and Justice, in addition to Intelligence-Security Agency of BIH, State Agency for Investigations and Protection, BIH Broder Police, Directorate for Police Bodies Coordination, Federal Police Administration, Ministry of Interior of Republika Srpska, Police of the Brčko District of BIH, as well as relevant Entity and Brčko District institutions and cantonal bodies responsible for health care, social protection and education. They will be engaged through the Coordination Body of Republika Srpska, Federal Government Cross-Sector Work Group and Brčko District of BIH Coordination Body for prevention and fight against terrorism..
ACTION PLAN FOR COMMUNCAITION STRATEGY IN EU ACCESSION PROCESS
The session adopted the Council of Ministers Action Plan for implementation of the Communication Strategy for raising public awareness on the EU accession process of Bosnia and Herzegovina for year 2021, upon a proposal of the Directorate for European Integrations.
Nine institutions of Bosnia and Herzegovina were included in the preparation of the Action Plan for making the public better informed of the European integrations process in BIH. In that regard, planned were activities in the area of publishing, on-line communication, research, competition ads, events and promotion materials.
