Council of Ministers of BIH Holds Its 50th Session

The Council of Ministers of BIH took the Ministry of Civil Affairs-proposed decision to set-up a State Committee for Border of Bosnia and Herzegovina, in accordance with the Law on Border Control, after the previous Committee’s mandate expired.
The State Committee for Border, featuring six, instead of previously nine members, was appointed to a three-year mandate, to include a representative from each state Ministries of Civil Affairs and Foreign Affairs (Davor Bošnjak and Emir Vladavić) and representatives of Entity geodetic/property-legal administrations (Nenad Bajić, Bojan Ninčić, Željko Obradović and Zijad Džananović).
The State Committee for Border of BIH will be engaged on border identification, together with competent bodies of neighbouring countries and will supervise marking and stabilisation of border line. It will also prepare proposals for correction of border line and inter-government contracts and other border line-relevant acts with the neighbouring countries.
LAST YEAR’S BIH BUDGET EXECTION REPORT ADOPTED
The session adopted 2023 Bosnia and Herzegovina Institutions and International Obligations Budget Execution Report, to be provided to the BIH Presidency and Parliamentarian Assembly and published at the Ministry of Finance and Treasury and Council of Ministers web sites.
The total realised incomes, financing, and receivables at disposal to BIH Institutions in 2023 were KM 1,398,210,337 and they were executed in amount higher for about KM 166 million or 16% relative to 2022, when financing was made based on temporary financing decisions throughout the first half of the year.
Also, in the Q1 2023, financing of BIH Institutions was made based on an Instruction on Temporary Financing of BIH Institutions, because the Law on Budget of BIH Institutions and International Obligations for 2023 was adopted on March 30, 2023.
Based on foreign debt obligations in 2023, paid was KM 1,255,22 million, thus servicing foreign obligations in full.
OSA PERMANENT ACCOMODATION PROJECT
The Council of Ministers of BIH tasked the Intelligence-Security Agency of Bosnia and Herzegovina (OSA BUH) to form a work group, in cooperation with the General Affairs Service of BIH Institutions, for implementation and monitoring of a facility construction project for accommodation of the OSA BIH.
An earlier adopted report on realisation of CoM conclusions from its 28th session held on Nov.9, 2023, contains a hologram of activities with dynamics of the project implementation, financial estimate, and facility design for the needs of the OSA BIH.
The aim of the project is to solve the issue of accommodation of the OSA BIH, with adherence to international and standards prescribed under the Law on Protection of Classified Data, at earlier approved site at the Adama Buće St., procured in 2026 and registered to Bosnia and Herzegovina, while the construction works pend on funds availability.
The assessment of needed financial investments is total KM 30,000,000, and it was developed based on the project development and utility costs by phases, while the finalisation of the construction is expected by the end oof 2026.
TO REVISE ACTION PLAN FOR IMPLEMENTATION OF “SEJDIĆ-FINCI” COURT AWARD
The Council of Ministers of BIH took note of a request by the joint Collegium of both chambers of the BIH Parliamentarian Assembly of BIH from its 6th session, held on Dec. 17, 2023, as to providing a piece of information on activities on implementation of awards by the European Court for Human Rights from the group of files “Sejdić and Finci vs Bosnia and Herzegovina”.
The Ministry of Justice of BIH is tasked to revise the Action Plan for implementation of the ECHR awards on group of files “Sejdić and Finci”, and to report the Council of Ministers accordingly.
NON-ADOPTION OF PIECE OF INFORMATION ON IMPLEMETNATION OF ICSID COMMITTEE DECISION
The Council of Ministers of BIH failed after two rounds of voting to reach agreement to adopt a piece of information by the BIH Chief Attorney’s Office on the ICSID Committee decision to annual an arbitrage award in process Viaduct,Ltd. Portotrož, Vladimir Zevnik and Boris Goljevšček vs Bosnia and Herzegovina.
Thus, the Council of Ministers failed to adopt a proposed conclusion, inviting the Government of Republika Srpska to act immediately upon both a decision by the ICSID casc.No.ARB/16/36, of May 1, 2024 and Tribunal award of April 18, 2022.
The BIH Chief Attorney’s Office briefed the Council of Ministers of BIH of already sent documented request to the Government of Republika Srpska for action upon the decision of ICSID Committee on annulment of the arbitrage decision in this process and award by the Tribunal, of April 18, 2022.
In line with the award presented, provided by claimant’s legal representatives to the BIH Chief Attorney’s Office for claimed Bosnia and Herzegovina, the total costs of this arbitrage procedure are EUR 52,794,412 with interest running starting from the date of the verified decision.
The Council of Ministers of BIH and Government of Republika Srpska had earlier concluded an agreement on mutual rights and obligations concerning arbitrate procedures, which obliges the Government of Republika Srpksa to fulfil unconditionally all its payment obligations against award taken in an arbitrage procedure on behalf of Bosnia and Herzegovina, upon receipt of the documented request from the BIH Chief Attorney’s Office.
The Viaduct,Ltd Portorož, Vladimir Zevnik and Boris Goljevšček from Piran, the Republic of Slovenia, initiated an arbitrage procedure against BIH before the Washington-based International Centre for Solving Investment Disputes for indemnity for damage caused by violation of provisions of both an Agreement on Reciprocal Investments Promotion and Protection between Bosnia and Herzegovina and the Republic of Slovenia and Treaty on Energy Chart. The reason is non-realisation, i.e. termination of a contract on concession for development of hydro-power system on the River Vrbas, concluded with the Government of Republika Srpska.
NO ALLOWED HUDGET RESERVE FUNDS TO BIH PROSECUTR’S OFFICE
The Council of Ministers of BIH failed to take decision to approve KM 700,000 to Bosnia and Herzegovina Chief Prosecutorial Office from the Budget reserves for April 2024. (end)
